# Terms of Service **TucsonIronQuotes.com** Operated by Metal Contract Group LLC **Effective Date:** [09/08/26] **Last Updated:** [09/08/26] --- ## PLEASE READ THIS FIRST **We are not a contractor and we do not build anything.** We are a referral service that connects you with independent metal fabrication businesses. We do not perform work, supervise work, inspect work, price work, or guarantee work. Any contract you sign is between you and the fabrication shop, and we are not part of it. **Section 14 requires most disputes to be resolved by individual arbitration and waives your right to a jury trial and to participate in a class action.** You may opt out within 30 days. --- ## 1. Agreement to These Terms These Terms of Service ("Terms") are a binding agreement between you and Metal Contract Group LLC ("MCG," "we," "us," or "our"), an Arizona limited liability company doing business as TucsonIronQuotes. By using TucsonIronQuotes.com (the "Site"), submitting a quote request, or communicating with us, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. **If you do not agree, do not use the Site and do not submit a request.** --- ## 2. What This Service Is TucsonIronQuotes.com is a free lead-matching service for homeowners and business owners in the Tucson, Arizona area who want metal fabrication work — ornamental iron, fencing, gates, doors, railings, staircases, canopies, pergolas, storefronts, repairs, and custom fabrication. You submit a description of your project. We route that request to one or more independent metal fabrication businesses ("Fabricators") who serve your area. Those Fabricators contact you directly to discuss the project and provide their own pricing. **We are paid by Fabricators, not by you.** Fabricators pay us a fee for each quote request we deliver. You pay us nothing. --- ## 3. What This Service Is Not This section is the most important part of these Terms. By using the Site, you acknowledge and agree that: **a. We are not a contractor.** MCG is not a licensed contractor and does not hold a license from the Arizona Registrar of Contractors. We do not perform, offer to perform, undertake, subcontract, or supervise any construction, fabrication, welding, or installation work of any kind. **b. We do not provide quotes, bids, or estimates.** Despite our domain name, **all pricing comes from Fabricators, not from us.** We never quote a price, prepare a bid, negotiate price or scope, or estimate the cost or duration of your project. Any number you receive comes from a Fabricator and is that Fabricator's alone. **c. We are not a party to your contract.** Any agreement, contract, proposal, deposit, payment, warranty, or dispute is strictly between you and the Fabricator. We are not a party to it, not a guarantor of it, and not responsible for it. **d. Fabricators are independent.** Fabricators are not our employees, agents, partners, joint venturers, franchisees, or representatives. They are independent businesses. We do not control their conduct, pricing, scheduling, workmanship, staffing, or business practices. Nothing a Fabricator says or promises binds us. **e. We do not endorse or guarantee any Fabricator.** We may perform basic checks on Fabricators before working with them, which may include confirming business registration, contractor license status where applicable, and insurance. **These checks are limited, are not a background investigation, are accurate only as of the date performed, and are not an endorsement, recommendation, certification, warranty, or guarantee of any Fabricator's licensing, insurance, competence, honesty, financial condition, or work quality.** We do not monitor Fabricators on an ongoing basis. **f. You are responsible for your own due diligence.** Before hiring any Fabricator, you should independently verify their license at **roc.az.gov**, confirm their insurance and bonding, request and check references, review their contract before signing, and obtain competing bids. We strongly recommend you do all of these things. Your decision to hire is yours alone. **g. We do not guarantee any outcome.** We do not guarantee that any Fabricator will contact you, respond in any timeframe, be available, quote your project, agree to your budget, accept your job, or complete work satisfactorily. We do not guarantee any number of quotes. --- ## 4. Eligibility and Your Obligations To use this Site you must be at least 18 years old and legally able to enter contracts. When you submit a request, you represent that: - All information you provide is true, accurate, current, and complete - The phone number and email address you give are yours, and you are the regular user of that phone number - You own the property described, or you are authorized by the owner to solicit and arrange work on it - You have a genuine, good-faith interest in obtaining metal fabrication services - You are not a competitor, lead broker, marketer, researcher, or data collector submitting a request under false pretenses You agree not to: - Submit false, misleading, incomplete, or another person's information - Submit a phone number you are not authorized to provide - Use the Site to scrape, harvest, resell, or compile data - Attempt to interfere with, overload, reverse engineer, or gain unauthorized access to the Site or our systems - Use automated means to submit requests - Use the Site for any unlawful purpose We may refuse service, reject a request, or block access at any time for any reason. --- ## 5. Consent to Be Contacted By submitting a quote request and checking the contact consent box, you give prior express written consent for MCG and the Fabricators we match you with to contact you at the phone number and email address you provided, **including by automatic telephone dialing systems, prerecorded or artificial voice messages, and text messages**, even if that number is on a federal or state Do Not Call list. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of texts or HELP for help. **Consent to receive marketing calls or texts is not a condition of purchasing any goods or services.** You may instead request quotes by emailing [email protected]. You may revoke consent at any time by any reasonable means, as described in our Privacy Policy. Revoking consent with us does not revoke it with a Fabricator who already received your information; you must contact that Fabricator directly. --- ## 6. Your Information Is Sold **By submitting a request, you authorize us to sell and transfer your submitted information to one or more Fabricators, who will contact you and who will handle your information under their own privacy practices.** This is the entire purpose of the Site. Our Privacy Policy explains this in full, including our practice of exclusive placement for a limited period and possible later resale. Read it before submitting. --- ## 7. No Professional Advice Nothing on the Site is construction, engineering, structural, architectural, code-compliance, permitting, safety, legal, insurance, or financial advice. Any general information about materials, styles, costs, or processes is for background only. Metal fabrication and installation can involve structural loads, gates, egress, pool barriers, permits, HOA rules, and city and county code requirements. Consult qualified licensed professionals and your local permitting authority. --- ## 8. Intellectual Property The Site and its content — text, graphics, logos, photographs, layout, and software — are owned by MCG or our licensors and protected by intellectual property laws. You may not copy, reproduce, republish, scrape, or create derivative works from the Site without our written permission. By submitting photos, drawings, or descriptions, you grant us a non-exclusive, royalty-free, worldwide license to use, store, reproduce, and transmit that content for the purpose of operating the Site and delivering your request to Fabricators. You represent that you have the right to grant this license. --- ## 9. Third-Party Sites and Services The Site may link to third-party websites and relies on third-party services. We do not control and are not responsible for third-party content, products, services, availability, or privacy practices. Links are not endorsements. --- ## 10. Disclaimer of Warranties THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT. **WE MAKE NO WARRANTY WHATSOEVER REGARDING ANY FABRICATOR, INCLUDING THEIR LICENSING, INSURANCE, BONDING, QUALIFICATIONS, PRICING, SCHEDULING, CONDUCT, WORKMANSHIP, MATERIALS, OR THE SAFETY, DURABILITY, OR CODE COMPLIANCE OF ANY WORK THEY PERFORM.** Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you. --- ## 11. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW, MCG AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THE SERVICE, ANY FABRICATOR, OR ANY WORK PERFORMED OR NOT PERFORMED. **WE ARE NOT LIABLE FOR THE ACTS OR OMISSIONS OF ANY FABRICATOR, INCLUDING DEFECTIVE WORK, PROPERTY DAMAGE, INJURY, DELAY, ABANDONMENT, OVERCHARGING, FAILURE TO HONOR A WARRANTY, FAILURE TO OBTAIN PERMITS, OR ANY DISPUTE BETWEEN YOU AND A FABRICATOR.** OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITS APPLY REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. --- ## 12. Indemnification You agree to indemnify, defend, and hold harmless MCG and its owners, members, managers, employees, and agents from any claims, demands, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: - Your use of the Site - Information you submitted, including any phone number you were not authorized to provide - Your breach of these Terms or your violation of any law - Any dispute between you and a Fabricator --- ## 13. Governing Law These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Subject to Section 14, any action that proceeds in court must be brought exclusively in the state or federal courts located in Pima County, Arizona, and you consent to that jurisdiction and venue. --- ## 14. Dispute Resolution, Arbitration, and Class Action Waiver **PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.** ### 14.1 Informal Resolution First Before starting arbitration or a lawsuit, you agree to contact us at [email protected] with a written description of the dispute and the relief you want, and to give us **60 days** to resolve it informally. ### 14.2 Binding Arbitration If we cannot resolve the dispute informally, **you and MCG agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Service, our communications with you, or your relationship with us — including claims under the Telephone Consumer Protection Act and any statutory or tort claim — will be resolved by final and binding individual arbitration**, and not in court. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Pima County, Arizona, or by telephone or video at your election. The Federal Arbitration Act governs this section. The arbitrator may award any relief available in court, but only in favor of the individual party seeking relief. ### 14.3 Class Action Waiver **YOU AND MCG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.** The arbitrator may not consolidate claims or preside over any class or representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim must proceed in court, and the rest of this Section 14 still applies to all other claims. ### 14.4 Exceptions Either party may bring an individual claim in small claims court. Either party may seek injunctive relief in court for infringement or misuse of intellectual property. ### 14.5 Your Right to Opt Out **You may opt out of this arbitration and class waiver section by emailing [email protected] within 30 days of first accepting these Terms**, with the subject line "Arbitration Opt-Out" and including your name, phone number, and email address. Opting out does not affect any other part of these Terms and will not affect your use of the Service. ### 14.6 Jury Trial Waiver If for any reason a dispute proceeds in court rather than arbitration, **you and MCG each waive any right to a jury trial**. --- ## 15. General **Changes.** We may modify these Terms at any time by posting a revised version with a new "Last Updated" date. Material changes will be noted prominently on the Site. Continued use after changes means you accept them. Changes do not apply retroactively to disputes already noticed under Section 14.1. **Termination.** We may suspend or terminate your access at any time, with or without notice. Sections 3, 6, and 10 through 15 survive termination. **Severability.** If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions stay in effect. **No waiver.** Our failure to enforce any provision is not a waiver of it. **Assignment.** You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets. **Entire agreement.** These Terms and the Privacy Policy are the entire agreement between you and MCG regarding the Site and supersede any prior understandings. **Force majeure.** We are not liable for failures caused by events beyond our reasonable control. --- ## 16.
